The client worked for a supermarket as a shelf stacker. On the day of the accident he decided to help unload a delivery despite not being asked to do so. He was unloading a heavy cage, when its wheel caught on a safety flap on the edge of the tail-lift and the cage fell onto our client.
The claimant fractured 3 metatarsals. His injuries healed within 9 months apart from some very minor ongoing cold intolerance.
The Defendants denied liability on the basis that our client had not been asked to unload the lorry and therefore should not have been doing it. The case was eventually settled the week before trial. He received a four figure sum in compensation.
