In this case, our client slipped in a toilet cubical in Tesco, causing a soft tissue injury to her back and abdomen.

Liability was firmly denied and we had just reached the stage in proceedings where we were to receive directions.  Tesco very often rely on a defence of “clean as you go” which means the staff have to clean whenever they see a spillage.  The problem was that this accident occurred in the ladies public toilet which had no inspection after 8pm and the client fell just after midnight in one of their 24hr stores. This clearly was a fault in their inspection system where “clean as you go” will only suffice where the staff are likely to regularly “go”.

In this intance, we successfully achieved a four-figure compensation award.
