Slip On A Wet Floor

Our client was employed by the Defendant.  Our client walked into the lavatories at premises owned or occupied by her employer.  Our client slipped and fell because of water on the floor. Our client suffered a soft tissue injury to her lower back. 

We made arrangements for our client to see an orthopaedic specialist, who diagnosed a disc prolapse.  The client underwent micro-discectomy as a result of this.  The consultant was, however, of the opinion that the prolapse had not been caused by the fall.  The claim was therefore settled on the basis that she had suffered a soft tissue injury to her lower back with symptoms evident over only a short period of time.

Liability was not admitted by the Defendant in this case.  Our client’s evidence was contradictory.  She could not recall the the precise date of the accident, and initially confused the date of this accident with a previous accident which had occurred when she was on holiday abroad.  On both occasions she suffered an injury to her back.  There were conflicting entries in her medical records which suggested various symptoms of different durations. 

Her credibility was therefore questioned by the Defendant.  In the end though, the case was concluded successfully and a four-figure compensation sum awarded.
