Depending on the circumstances it may be necessary for you to see a medical expert. In a personal injury negligence case we may be able to use an existing report from a specialist. In medical negligence cases we will need to refer you to a Consultant who specialises in dealing with issues of this type.
The Specialist may also recommend any treatment and rehabilitation needed.
The Consultant specialist will produce a report upon which we will base your claim for compensation. The report will describe the extent of your injuries, your recovery and rehabilitation, and the ongoing health problems that you may have as a result of your accident. This report will form part of the evidence for your claim, and will have a bearing on the level of compensation that you receive.
Normally, this appointment will take place between 3 and 6 months after your accident. In cases of personal injury negligence, it's likely that more time will have elapsed since your injury. It is possible that you may already have a medical report that can be used. It is also possible that in cases of very serious injury it may be appropriate to have the medical examination at a later time, as the recovery process may take longer, and a clearer long term prognosis may not emerge until later.
It can be frustrating to endure a long legal process. However, it is far better to hold out for a fair level of compensation rather than rush into a quick settlement that may not be in your best interests. It may be possible to obtain interim payments from the defendant's insurers when claims take a long time to resolve.
